Fashion Industry Use of Design Patents

The fashion industry use of design patents to protect the fashion designers’ intellectual property from copycats is becoming a trend in the industry. Lululemon, a Canadian company, has been patenting its work out attire, as a protective mechanism from other copycat fashion designers. Lululemon has brought suit against other fashion designers, such as Calvin Klein Inc. and G-III Apparel Group Ltd. Lululemon has alleged patent infringement on Lululemon’s patented designs, especially those designs related to the waistband. By doing this, Lululemon is attempting to protect its products’ inventive designs against competitors by using legal safeguard in patent design.

Patent design litigation is not very common in the fashion industry, because it is expensive, time consuming and the infringer basically has to produce an exact replica of the product in order to infringe on the design. However, design product litigation is becoming a trend in the design and fashion industry where designers are seeking legal protections for their intellectual property rights. Read more
